1. The Plaintiff:
A. Defendant A Co., Ltd.: 449,125,590 won and 208,282,006 won among them, from June 27, 2003.
Reasons
1. Facts of recognition;
A. On March 15, 1997, Japan Bank Co., Ltd. (hereinafter “Japan Bank”) entered into a credit-limit trading agreement with Defendant A Co., Ltd. (hereinafter “A”) by setting the credit subject discount, the credit limit amount of KRW 300,00,00,000, and the transaction period of March 15, 1998. Defendant A loaned KRW 66,00,000 on December 26, 1996; ② KRW 25,850,000 on January 13, 1997; ③ 75,90,000,000 on February 17, 1997; ④ 32,00,000,000 on March 27, 1997; and ⑤ 5, 195,56,45,56,500 on April 15, 1995, respectively.
(hereinafter referred to as “each of the instant loans.” Defendant C andO jointly guaranteed each of the instant loans within the limit of KRW 360,000,000,000, Defendant D Co., Ltd. (hereinafter referred to as “D”) within the limit of KRW 390,000,000.
B. At the time of each of the instant loans, Defendant A approved that the instant credit transaction basic terms and conditions were applied, and accordingly, Defendant A agreed to comply with the prescribed interest rate set by the first bank.
C. Defendant F, Large Industry Co., Ltd. (hereinafter “Large Industry”), and G issued each promissory note as indicated in the following table with Defendant A as an addressee. Jeju Bank had possession of each of the said promissory note as security for each of the instant loans from Defendant A by endorsement and transfer, and offered payment at each of the instant payment dates, but all of them were refused.
