Defendant Tol Trade Co., Ltd.: 519,940,903 won and 47,633,126 won among them.
Reasons
1. Indication of claim;
(a) 1) An interesting Bank Co., Ltd. (A) merged with a new bank that was a stock company around April 2006 and became a new bank that was a stock company;
hereinafter referred to as “foreign bank”
(1) The Defendant Company shall be the General Trading Company (hereinafter “Defendant Company”).
B) As between September 16, 1996, a credit card subscription agreement was concluded and issued on September 16, 1996, and on September 3, 1996, the credit card was determined as KRW 30,00,000 on the same day, and determined as KRW 70,000 on September 21, 1996 general loan for loans of credit subjects, KRW 60,000 on the real estate mortgage loan of credit subjects, KRW 60,000 on September 21, 1996, and each of the above money was loaned within the limit of KRW 23,560,00 on June 27, 1997, with each of the above money lending loans set as KRW 23,00 on the credit card subscription agreement, within the limit of KRW 31,00 on June 27, 1997, each of the above loans was jointly and severally guaranteed within the limit of KRW 300,000 on each of the above loans under the monetary consumer loan agreement.
3 At the time of each of the above agreements, the Defendants approved that the credit transaction basic terms and conditions of the non-party bank apply, and accordingly, the interest rate and damages rate were to follow the prescribed interest rate set by the non-party bank to the extent permitted by the law.
B. On September 29, 1998, the non-party bank transferred the above credit to the plaintiff and notified the defendants of the transfer of credit at that time. After that, the plaintiff filed a lawsuit against the defendants and the non-party B seeking the payment of the above transfer amount under the Daejeon District Court 2004Gadan29733, and the plaintiff filed a lawsuit against the plaintiff and the non-party B for the payment of the above transfer amount, and the defendant company 290,619,640 won and 47,63,126 won among them from April 23, 2004 to July 31, 2004 as to the 19.5% per annum from April 23, 2004 to July 31, 2004 to 19% per annum from April 23, 2004 to July 31, 2004.
