A defendant shall be punished by imprisonment for not less than eight months.
However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
Despite the fact that the Defendant is not a narcotics handler, the Defendant dealt with the Metropha (copopon, hereinafter “coponon”) which is a local mental medicine as follows.
1. (1) On August 4, 2017, the Defendant: (a) conspired with C to share the amount of money with C to purchase the penphone; (b) around August 3, 2017, the Defendant transferred the sum of KRW 1.5 million, including KRW 7 million, to the accounts in which D used; (c) around August 3, 2017, around August 4, 2017, KRW 500,000,000,000,000,000,000,000 won, to the accounts in which D used; and (d) around August 22:30, 2017, around KRW 22:30,00,000, KRW 5 g of the phone contained in the plastic bag, and the Defendant received KRW 25 g of the phone from D’s 25 galon on the adjacent voice of G H car located in the north-gun located around the new wall around August 4, 2017.
Accordingly, the Defendant conspiredd with C to purchase philophones.
(2) On September 12, 2017, the Defendant: (a) delivered 800,000 won of opphones to K from the vicinity of the outlet No. 1 located in Jung-gu, Busan to D around September 12, 2017; and (b) purchased opphones by moving 5g of opphones from K to the opphones in the vicinity of the outlet No. 1 located in Jung-gu, Busan to the mobile phone; and (c) purchased opphones at that place.
2. (1) On September 12, 2017, the Defendant administered a philophone medication by inserting a 0.1g of philophone into a single-use injection machine, containing a clopon 0.1g of clopon from the trade name in the vicinity of the Busan City L around September 12, 2017.
(2) On December 30, 2017, the Defendant administered medicines in a way of injection into arms after inserting 0.1g of 0.1g of philophones from the 31st of the same month from the 30th of December, 2017 to the 31st of the same month.
