1. The punishment of the accused shall be determined by one year and three months;

Punishment of the crime

[2018 Highest 52] Notwithstanding the fact that the Defendant is not a narcotics handler, the Defendant treated the Mepter (one philopon; hereinafter “philopon”), which is a local mental medicine, as follows.

1. Purchasing philophones;

A. On August 2017, the Defendant: (a) given KRW 1.5 million in cash to B around the end of the same day; (b) around 21:00, the Defendant received approximately KRW 3.5 gramphones from E in the vicinity of D located in Suwon-si C, Suwon-si; and (c) at around 21:00, the Defendant received approximately KRW 3.5 gramphones

B. On September 25, 2017, the Defendant transferred KRW 2.3 million to G bank accounts (Account Number: H) in the name of F used by B around September 25, 2017, and received approximately five grams from B from B at around 01:00 the following day.

On October 6, 2017, the Defendant transferred KRW 1,300,000 to G bank accounts in F, and received approximately two grams from B from G in 23:00 Y building J around 23:00 on the same day.

On October 11, 2017, the Defendant transferred KRW 1,300,00 to G bank accounts in F, and received approximately two grams from B in around 23:00 as to the same day.

Accordingly, the defendant purchased philophones on a total of four occasions.

2. Medication of phiphones.

A. On the same day as described in paragraph (1) of this Article, the Defendant added approximately 0.05g philopon to the single-use telephone at Pyeongtaek-si and added approximately twice to his arms in the same manner.

B. On September 26, 2017, the Defendant inserted approximately 0.1g of philopon in a single-use telephone at the mutual influence in Dongdaemun-gu Seoul, Dongdaemun-gu, Seoul, and injected into his own arms after dilution with a fresh water.

On October 6, 2017, at around 23:30, the Defendant injected approximately 0.1g of phiphones into his arms after inserting approximately 0.1g of phiphones into a single-use injection machine from J Building K, and dilution with raw water.

(d)

On October 11, 2017, the Defendant, at around 23:30, added approximately 0.1g of philopon to a disposable injection machine from J Building K, and added it to his own arms after dilution with raw water.

Accordingly, the defendant extends to four times in total.
