A defendant shall be punished by imprisonment for not less than eight months and by a fine not exceeding 1,00,000 won.

When the defendant does not pay the above fine.

Punishment of the crime

[2014 Highest 936]

1. On March 4, 2014, from around 12:19 to December 12:00 of the following day, the Defendant entered Gwangju Northern-gu Seoul 3rd floor D stores to conduct the act as if he/she would pay the fee to the victim E, an employee, and was seated with a cartoon seat.

However, the defendant did not have any intention or ability to pay the fee, even if he/she reads a cartoon, because he/she did not have any intention or ability to pay the fee.

Nevertheless, the Defendant, by deceiving the victim as above, received convenience from the victim, such as cartoon subscription, etc., and exempted the amount equivalent to 28,000 won, thereby acquiring pecuniary benefits equivalent to that amount.

2. On March 5, 2014, the Defendant: (a) at the “D” store located in Gwangju Northern-gu, Gwangju Northern-gu, the Defendant: (b) arrested a flagrant offender from a slope G belonging to the F District of the Gwangju Northern Police Station to commit fraud; (c) had the risk of committing a crime of fraud; and (d) had the risk of committing a crime of committing a crime of fraud, using the H’s personal information acquired by means of a fine unpayment; and (c) had the Defendant committed a crime of conspiracy using the same as H.

On March 5, 2014, the Defendant entered “H” in the F District of the Gwangju Northern Police Station F District located in Gwangjubuk-gu, and forged the signature of H without authority for the purpose of exercising the above H’s name by affixing the seal on the back of the H name.

B. At the same time and time as above, the Defendant entered “H”, “I”, and “Ybuk-si,” respectively, in the name column of the site of the written statement provided by the said slope G in the name column of “H”, “I”, and “H,” and signed “H,” with the content of the case circumstances indicated.

Accordingly, for the purpose of exercising authority, the Defendant forged a written statement under H’s name concerning a certificate of fact.

[20] The Defendant, from June 28, 2013 to June 17:40 of the same day, should pay the normally used fee from the LP (PC) bank located in the Southern-gu, Gwangju, which is operated by the Victim JJ from June 28, 2013 to the day of the same day.
