Defendants are not guilty.

1. Defendant A was the president of Asan City medical corporation D (hereinafter “instant medical corporation”) located in Asan City from June 21, 2012 to June 9, 2014, and Defendant B was the representative director of E Co., Ltd. (hereinafter “E”) and the head of the administrative president of the instant medical corporation established by the instant medical corporation, who was overall in charge of administrative affairs from the establishment of the instant medical corporation to the establishment and operation of the F medical care hospital.

No person, other than a medical doctor, herb doctor, dentist, midwife, State, local government, medical corporation, non-profit corporation or quasi-governmental institution, may establish a medical institution.

After establishing a medical corporation, the Defendants conspired to establish and operate the medical corporation and the medical corporation for profit by formally appointing executives such as the director of the medical corporation, and establishing a structure of personal control over the medical corporation, by operating the medical institution, and by operating the medical corporation's property for private use and operating the medical corporation and the hospital for profit.

Defendant

A, through Defendant B with experience in operating a hospital at the beginning of 2012, intended to introduce a consultation G to establish a medical corporation and to proceed with the procedures for establishing a medical corporation.
