A defendant shall be punished by imprisonment for a term of one year and two months.
There are 12 copies of each passbook seized (Nos. 1, 4, 8 through 17) and each bank card.
Reasons
Punishment of the crime
1. Around February 2015, the defrauded received a proposal to offer a loan to an unspecified number of victims from C (along with a life-saving) that he/she came to know at a regional friendship group and received a proposal to offer a daily wage if he/she is a cash withdrawal from the victims to receive money on the pretext of partial repayment of the existing loan for a new loan, goods price, etc. from the victims.
Accordingly, the “Singishing” staff, on the name of the victim, acquired the large account necessary for financial transactions from the large number of account holders and delivered it to the defendant through C, etc., while allowing a large number of victims to transfer money under the name of partial repayment, etc. of existing loans for a new loan to the large account that has been secured as if they would make loans to the large number of unspecified victims. The defendant, as instructed by C, transferred money to C by using the cash card and password that the victims received in advance the money transferred to the large account from the large number of account holders, or directly delivered money to C, D, and D, by means of money transfer from the victims to the one bank account under C, cash card and password that the victims received in advance, or direct transfer of money from the victims to the bank account under C, and then conspired in order with C, C, and D.
On April 10, 2015, the aforementioned “Singishing” staff stated that “The victim E will give a loan at low interest by telephone at a non-permanent place. However, to obtain a new loan, the said staff stated that “I shall pay part of the existing loan to the account known as KRW 1,440,000,000,000, and transfer it to the account known as such.”
However, the facts did not have the intention or ability to lend to the victim E.
