Punishment of the crime

On November 2013, the Defendant received a proposal that 1.5% of the withdrawn amount will be paid if he/she takes money under the name of another person, such as a loan fee, from the head of the B office on the name of the Police Officer, to make a loan to an unspecified number of victims, and he/she takes money in the name of another person, which he/she has secured in advance from the victims (hereinafter referred to as the “spoking account”), and accepted it.

As a result, the members of the B Office et al. taken over the large account necessary for financial transactions from the holders of a large number of large-scale account and delivered cash cards and passwords connected thereto to the cash withdrawal account of the Defendant et al. In order to transfer money to the large-scale unspecified victims under the name of lending fees, etc., the Defendant: (a) as ordered by B Office, etc. from the Defendant, etc. through the “Kakakaok”); and (b) as ordered by B Office, etc., deposited the money transferred by the victims to the large account into the Defendant’s account; and (c) the members of the B Office et al., etc., etc., sent the money deposited to the Defendant’s account by using the cash card and password that received in advance the money transferred by the victims to the large account and deposited the money deposited to the Defendant’s account under the Defendant’s name by using the password of the Defendant’s account received in advance from the Defendant.

Around December 3, 2013, the chief of B et al. stated that “A loan of KRW 5 million may be granted to the victim C by telephone, and a loan may be granted by remitting a loan fee of KRW 1,820,000 to a security deposit.”

However, in fact, there was no intention or ability to lend money to the victim by the officers of the B et al.
