A defendant shall be punished by imprisonment for not less than one year and six months.
Reasons
Punishment of the crime
On September 26, 2012, the Defendant was sentenced to one year and two months of imprisonment with labor for forging private documents at the Changwon District Court on September 26, 2012 and completed the execution of the sentence at the Changwon detention center on July 4, 2013.
1. Fraud;
A. On July 13, 2014, at around 13:00, the Defendant: (a) received food and alcohol equivalent to KRW 38,000 in the market price from the victim; (b) in fact, the Defendant did not have the intent or ability to pay the price even if having ordered food and alcohol, and (c) received food and alcohol equivalent to KRW 38,00 in the market price from the victim.
B. On August 1, 2014, at the early 09:00, the Defendant, despite having no intent or ability to pay the price for food and beverage, was provided with food and beverage equivalent to KRW 38,000 at the market price by the victim.
C. On September 16, 2014, the Defendant: (a) had the victim F of the instant taxi drive the said taxi at the time of the new wall in Busan, Busan, Seo-gu, Busan; (b) had the victim F of the said taxi to pay the said taxi fee in a normal manner, despite the absence of the victim’s intent or ability to pay the taxi fee due to the lack of money in the number, even if he/she was aboard the taxi that was operated by F of the said passenger; and (c) had the victim drive the said taxi at the time of the f of the Kimhae-si, the Defendant had the victim drive the said taxi and did not pay 43,000 won for the taxi fee.
2. Interference with business;
A. On August 25, 2014, around 21:30 on August 25, 2014, the Defendant interfered with the victim’s operation of the victim H in Kimhae-si, by, under the influence of alcohol, taking the victim’s h’s cryp to a large amount of interest without any justifiable reason, and obstructing the victim’s operation of the cryp to a large amount of 1:30 minutes.
B. The Defendant, around 10:50 on September 4, 2014, operated the Victim K in the J of Kimhae-si.
