피고인은 2019. 8. 16. 23:30경부터 다음 날 00:30경까지 서울 마포구 B에 있는 C 앞 노상에서 ‘편의점에 술 취해 의자에 앉아서 안가고 있다’ 는 112신고(D)를 접수받아 현장 출동한 E파출소 소속 경찰관 F에게 “씨발 놈아, 내가 뭘 잘못 했냐, 때려봐라, 해봐라, 때려줄게, 공무집행방해죄로 체포해라, 좆같은 새끼, 짭새 새끼, 저 덩치만 큰 새끼가 어린놈의 새끼" 라는 등 불특정 다수가 통행하는 도로변에서 큰소리로 공연히 피해자를 모욕하였다.
