A defendant shall be punished by imprisonment for one year.
Reasons
Punishment of the crime
Around October 2019, the Defendant received a proposal from a person whose name in China is unknown (hereinafter “B”), stating that “The Defendant would collect bonds jointly with the right to finance.” The Defendant would pay 5% of the amount received when he/she talks with the people at the place to instruct, and transfers the funds to the employees of financial institutions, as he/she will receive money from the said persons.”
In fact, while the Defendant instructed the Defendant to receive money from many unspecified persons, the Defendant: (a) instructed the ordinary financial institutions such as disclosing that the Defendant was a Chinese person, acting as if he was a Korean person; (b) reported or received money from other people; and (c) knew that B et al. was to use money by misrepresenting bank staff, etc. and deceiving many and unspecified persons; (d) provided that the Defendant was aware that B et al. was to use money by deceiving a large number of unspecified persons; (b) provided that in order to assist the Defendant, B et al. received money from an unspecified number of unspecified persons and remitted money to B et al.; and (c) paid fees to the account that

On January 17, 2020, the singishing employee, who was unable to know the name of the victim C, such as the fraud aiding and abetting B, called the victim C (the age of 48) by telephoneing to the victim C (the age of 17, 2020 and misrepresenting the staff of the D company. “In order to repay all the existing loans, it is possible to make loans to be provided by the Government, and first 6 million won is remitted to the F account in the name of F in order to repay the loans of 9.6 million won in E, and the victim transferred the amount of KRW 6 million to the F Association account (H) account known by the said Organization around January 16, 2020.”
Afterwards, the employees of Bosing T-B, etc. whose name is unknown, shall make a call again to the above victim at a non-permanent place on January 20, 2020.
