A defendant shall be punished by imprisonment for two years.

The seized evidence shall be confiscated, respectively.

Punishment of the crime

The defendant of "2019 Highest 1098" is a foreigner of the People's Republic of China's nationality, and is not a person handling narcotics, and thus is not a person handling narcotics, he/she shall not purchase a clopon (one copon; hereinafter referred to as "copon").

Nevertheless, around July 8, 2018, the Defendant decided to purchase approximately 0.6g of opon from the opon seller using opon (AB) in KRW 700,000,000. On the same day, around 05:21, the Defendant transferred KRW 700,000 of opon to the virtual account (I) in the name of the E bank account (H) in the name of the Gangnam-gu Seoul building and the E BankF Hospital branch office in the first floor (D), which the seller informed to the seller, at the place designated by the seller, and purchased the opon by using a opon with approximately 0.6g of opon, which is attached to the opon line installed in the opon in the offline in Gangnam-gu Seoul Metropolitan City, which is a place designated by the seller.

Even though the Defendant is not a person handling narcotics, the Defendant handled the psychotropic drugs-related Mesofts (one philopon; hereinafter “philopon”), as follows:

1. The policy of selling philophones (one-name “J”) intended to communicate with the philophone buyers residing in Korea through K and other smartphone hosting operations to sell philophones by the method of “clogram” in contact with the philophone buyers residing in Korea, and recruited persons who conceal philophones to sell philophones to the philophone buyers.

On May 2019, the Defendant accepted the proposal from the above “J” to the effect that the Defendant would divide the phiphone into a certain place in accordance with the direction of his/her own body and bring it to a specific place, photograph and transmit the pictures to him/her, and pay them for a certain price.

Accordingly, the “J”, around 02:55 on May 18, 2019, intended to sell approximately 5 g of phiphones to L who contacted K, and received KRW 6,000 of Chinese money ( approximately 1,023,890 of Chinese money) from phiphones.
