1. All appeals by the Defendants are dismissed.
2. The costs of appeal are assessed against the Defendants.
The purport of the claim and appeal is the purport of the appeal.
Reasons
1. The fact-finding and decision of the first instance court are justified even if the evidence submitted in the first instance court for the acceptance of the judgment of the first instance is based on the evidence submitted to this court.
Therefore, the reasoning of this Court concerning this case is consistent with the reasoning of the judgment of the court of first instance, except for the addition or modification as follows, with the exception of the addition or modification as to “2. Addition or modification. . . . . . . . .”
2. Additional or modified parts are 2 pages 7 to 8, “from May 7, 2009, from one point to another,” deleted.
2. The 12th place "the right to receive reimbursement" is deleted.
On the 3rd page 9, the Defendant appears to be “the Defendant,” “the Defendant,” respectively.
4. 5 pages 4. The following shall be added to the Plaintiff’s “as the Plaintiff seeks.”
4) On June 1, 2019, the “15% per annum prescribed by the former Act on Special Cases Concerning Expedition, etc. of Legal Proceedings” is deemed to be 15% per annum pursuant to Article 2(1) of the Addenda to the Act on Special Cases Concerning Expedition, etc. of Legal Proceedings (Presidential Decree No. 29768, May 21, 2019) and the main sentence of Article 3(1) of the former Act on Special Cases Concerning Expedition, etc. of Legal Proceedings (amended by Presidential Decree No. 29768, May 21, 2019).
If, barring any special circumstance, the authenticity of the seal imprinted by the person under whose name the signature was affixed on the document 16-18, i.e., the act of affixing the seal is based on the will of the person under whose name the document was prepared, barring any special circumstance, the authenticity of the entire document is presumed in accordance with Article 358 of the Civil Procedure Act when the authenticity of the seal imprinted is presumed, and when the authenticity of the private document is presumed, the authenticity of the document is presumed to have been created, and when the person under whose name the document was prepared does not prove that the seal was stolen or forged, the authenticity shall be denied.
