Reasons
Punishment of the crime
The defendant was a person who was a preliminary candidate for the election for the 20th National Assembly member on April 13, 2016.
1. Violation of Article 48 subparagraph 2 of the Political Funds Act;
(a) Expenditure of political funds (200,000 won in cases of a preliminary candidate for an election for public office) other than election expenses in excess of 500,000 won shall be made by checks, deposits in a credit card or a deposit account, or by other methods confirmed by the real names;
Nevertheless, the Defendant, at the Defendant’s election office on November 30, 2015, spent 6,000,000 won of political funds, other than election expenses, in cash, in the name of election campaign office rent, from that time to April 30, 2016, from that time, from that time, the Defendant did not spend the total amount of KRW 18,180,000,000, in cash, and did not use political funds, other than election expenses, in a way that the real name can be confirmed, as shown in the attached list of crimes (1).
(b) Political funds that can be disbursed annually in cash shall not exceed 20/100 of the total annual expenditure.
Nevertheless, on November 30, 2015, the Defendant spent 6,000,000 won for political funds under the name of the election campaign office in cash, from that time to May 2, 2016, as well as from that time, from that time, from May 2, 2016, the Defendant spent 4,60,000,00 won in cash, exceeding 20/100 of the total amount of political funds disbursement of 60,483,738 won ( approximately 12,096,747 won) over 79 times in total, such as in the attached list of crimes (2).
2. Violation of Article 49 (2) of the Political Funds Act.
(a) Election expenses in excess of 200,000 won shall be disbursed by checks, credit cards or deposit accounts, or by other methods confirmed by real names;
Nevertheless, on December 4, 2015, the Defendant spent election expenses of KRW 2,00,000 in cash for the purpose of photographing candidates’ photographs at the above election office from that time to May 2, 2016.
