Punishment of the crime

The Defendant is a foreigner with registration of refugee application for G-1-5, and the Defendant is a person who is called “C” to arrange employment against Chinese nationals who entered Jeju-do for employment by using a non-private certificate system.

Nevertheless, the Defendant introduced, without being registered, D, a Chinese citizen who did not have the status of sojourn eligible to engage in job-seeking activities in September 2016, to work in the dry field, wals field, wals field, and wals field located in the Jeju, and received KRW 1,106,000 in total from August 2016 to February 21, 2017, as shown in the list of crimes in the attached Table, and introduced, and received approximately KRW 1,106,000 in total, from August 2016 to February 21, 2017.

As a result, the defendant did not register with the competent authorities, provided domestic-paid job placement services, and arranged the employment of foreigners who do not have the status of sojourn eligible for employment activities as a business.

The act of providing unregistered fee-charging job placement services and arranging the employment of foreigners as one single act does not seem to be a single act, and thus, the crime of violation of the Occupational Stabilization Act and the crime of violation of the Immigration Control Act are recognized as a substantive concurrent relationship.
