피고인들은 2017. 3. 30. 02:30 경 경주시 D에 있는 E 주점 A 룸에 손님으로 들어가서 유흥 도우미를 불러 양주를 마신 후 계산하는 과정에서 종업원인 피해자 F(33 세) 이 술값을 깎아 주지 않는다는 이유로 화가 나서, 피고인 A은 위험한 물건인 양주잔을 2회에 걸쳐 피해자를 향해 던져 양주잔이 피해자의 뒷편 벽에 맞아 깨지면서 생긴 파편이 피해자의 얼굴에 튀어 피가 나게 하고, 얼음이 담긴 통을 피해자를 향해 던져 얼음 통과 얼음이 깨지면서 생긴 파편이 피해자의 얼굴에 튀게 하고, “야 이 개새끼야 말 해봐 라 ”라고 하며 피해자의 멱살을 잡아 흔들고, 피고인 B은 피해자의 멱살을 잡아 방 구석으로 밀어붙인 후 주먹으로 피해자의 얼굴을 수회 때리고 발로 피해자의 양 다리를 수회 걷어찼다.
