1. The Defendant indicated in the attached Form No. 1, 2, 3, 5, 8, 8, 8, 8, 100 square meters to the Plaintiff among the 727 square meters in Incheon Spojin-gun.

1. Facts of recognition;

A. The Plaintiff is an owner who completed the registration of ownership transfer on November 27, 2015 with respect to D Forest land 741 square meters in Incheon po-gun, Incheon po-gun, and the Defendant is an owner who completed the registration of ownership transfer on February 8, 1990 with respect to 1,904 square meters prior to the said land, Incheon po-gun E (hereinafter “E”) adjacent to the said land.

B. Since then, the area of 1,904 square meters prior to E was divided into two square meters for F-road, 49 square meters prior to G, and 727 square meters prior to H on November 18, 2016.

C. Nonparty I (the owners of J, K, L, M, N,O, P, etc.), Nonparty Q and R (J co-owners), including the Plaintiff and the Defendant, respectively, prepared and exchanged a written consent to land use for the other party when developing the land owned on January 26, 2016. Among them, the main contents of the written consent to land use (Evidence A No. 2-4) are as follows.

The current site status of the land use approval: The consent to use the land in relation to D, S, and the application for permission for development of a building in 1,902 square meters in Incheon S, S, and the application for permission for conversion of a mountainous district shall be granted for the above site.

In addition, we agree to designate and publicly announce the same road as a road under the Building Act under the Article 35 (Designation, Abolition or Alteration of Road) of the Building Act, and agree to the above-mentioned road as a sewage pipeline and the use by others.

A person who is entitled to use a site: The defendant (B) owner: the plaintiff (A).

D. In order to construct a detached house on the ground owned by the Plaintiff, the Plaintiff submitted relevant documents to the Vindication Military Service, which had jurisdiction over the firstman on April 2016, and is under construction.

E. The road area for which the Defendant completed the registration of subdivision in accordance with the Plaintiff’s written consent for land use is 174 square meters in the ship, which connects each point of the attached Form No. 1, B, C, D, M, Ba, F, Ba, G, A, A, car, car, other, in sequence, among H’s 727 square meters in size prior to H.
