The judgment below

Among the crimes of No. 2-b, No. 3-b, No. 4-b, No. 8-b, and No. 9-b.

1. Summary of grounds for appeal;

가. 피고인 A의 주장 (1) 사실 오인 내지 법리 오해 ㈎ 피고인 A은 의사인 AP에게 AC 의원 개설을 허락하였음에도 원심은 사실을 오인하여 피고인 A이 비의료 인인 C에게 AC 의원 개설 명의를 대여하였음을 전제로 이 부분 의료법 위반죄 및 사기죄를 유죄로 인정하였다.

㈏ 사단법인 J 협회( 이하 ‘ 이 사건 법인’ 이라 한다) 는 의료기관을 개설할 적법한 권한을 가지므로, 이 사건 법인이 AH 치과, AE 치과의원, AA 요양병원, AL 의원, AM 의원, AN 한의원을 개설하여 직접 운 영하였다고

Even if the violation of the Medical Service Act is not established, it does not constitute fraud even if the medical care costs are paid.

Nevertheless, the court below erred by misapprehending the facts or by misapprehending the legal principles, thereby finding the Defendant guilty of violation of the Medical Service Act and fraud.

㈐ AA 요양병원 관련 요양 급여비용 752,241,880원 편취 범행의 경우 피고인 A에 대하여 2014. 8. 18. 판결이 확정된 죄와 형법 제 37조 후 단 경합범 관계에 있음에도 원심은 법리를 오해하여 이를 간과하였다.

(2) The punishment sentenced by the lower court (one year of imprisonment and four years of imprisonment) is excessively unreasonable compared to the degree of Defendant A’s responsibility.

B. Defendant I’s assertion (1) misunderstanding the facts, Defendant I resigned from the position of the representative director of the instant legal entity on June 8, 2012, and on October 20, 2012, Defendant I resigned from the position of the director of the instant legal entity and did not intervene in the operation of the instant legal entity. However, the lower court found Defendant I guilty of the crime of defraudation of medical care benefits after June 8, 2012.

In addition, the joint defendant A was guilty of the crime of defraudation of medical care benefits after September 2013, which he received AA convalescent hospital from B, and also committed an illegal act that affected the conclusion of the judgment by misunderstanding the facts.
