A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

피고인은 계속하여 피해자가 앉아 있는 시트를 뒤로 젖혀 피해자가 누운 자세가 되게 하고 피해자의 몸 위에 피고인의 몸을 기대면서 눌러 피해자가 반항하지 못하게 한 다음 피해자의 옷 속에 손을 넣어 가슴을 만지고, 브래지어와 옷을 위로 올린 후 피해자의 가슴을 입으로 빨고, 왼쪽 손을 팬티 속으로 집어넣은 후 피해자의 성기 안에 피고인의 손가락을 넣어 흔들고 성기 바깥 쪽을 비벼 만지다가 흥분되자 아예 조수석으로 넘어가 피고인이 입고 있던 바지와 팬티를 벗고 피해자의 바지와 팬티를 맨 밑까지 내린 다음 피해자의 몸 위로 올라 타 피고인의 성기를 피해 자의 성기에 비볐다.
