Reasons
1. On September 23, 2014, at around 21:11, the Defendant sent a text message stating that “I will see the victim E (the 18-year-old-gu-gu-gu-gu-gu-gu-gu-gu-gu-gu-gu-gu-gu-gu-gu-gu-type-type-type-type-type-type-type-type-type-type-type-type-type-type-type-type-type-type-type-type-type-type-type-type-type-type-type-type-type-type-type-type-type-type-type-type-type-type-type-type-type-type-type-type-type-type-type-type-type-type-type-type-type-type-type-type-type-type-type-type-type-type-type-type-type-type-type-type-type-type-type
As a result, the Defendant sent text messages that may cause sexual humiliation or aversion through telecommunication media with a view to inducing or meeting his or other persons' sexual desire.
2. However, it can be acknowledged that the defendant's statement (the statement of the defendant in the first trial record, the police interrogation protocol of the defendant), the victim's statement (the police's statement of the victim), text message is written, and the defendant sent text message of the same content as the above facts charged through these evidences.
However, in order to establish obscene acts using communications media, “for the purpose of inducing or meeting one’s own or another person’s sexual desire.” Examining the above evidence, it is insufficient to acknowledge the fact that the Defendant sent the above words to the victim in his mind that the victim was not the victim of F’s examination, and that there was a purpose of inducing or meeting the victim’s own or another person’s sexual desire, and there is no evidence to prove otherwise.
3. If so, the facts charged in this case constitute a case where there is no proof of crime, and thus, it constitutes the latter part of Article 325 of the Criminal Procedure Act.
