1. The defendant shall recover the authentic title with respect to the portion of 1065/1940 out of the real estate listed in paragraph (2) of the attached list from the plaintiff.

1. Facts of recognition;

A. B completed the registration of ownership transfer on April 13, 1981 with respect to the land of 1,940 square meters (hereinafter “instant land before the instant partition”) in Jung-si, Jung-si (hereinafter “instant land before the instant partition”).

B. From November 1, 1984 to December 1988, the head of the Seoul Regional Construction and Management Administration, the Ministry of Land, Infrastructure and Transport, under the Ministry of Land, Infrastructure and Transport, performed the “large-area Water Supply Project of the Seoul Metropolitan Area (stage 3)” (hereinafter “instant project”) with the purpose of “the expansion of water supply facilities to cope with the difficulties in water supply of the water sources located in the 88 Olympic Winter City and the Seoul Metropolitan Area,” and the outline of the project is to install two water-flow stations, two water-supply stations, three water-supply stations, three pressure stations, and the total sum of 123.8km, 12.65km as water-supply pipes with the water pipes.

C. In order to implement the instant project on August 19, 1988, the Defendant accepted 875 square meters of the land prior to the instant partition as a incorporated land (hereinafter “instant land expropriation”), and completed the registration of transfer of ownership in the Defendant’s name as to the share of 875/1940 of the said land on the ground of the instant land expropriation on December 2, 198.

On January 23, 1989, the land prior to the instant subdivision was divided into 1,299 square meters, D 569 square meters, and E 72 square meters, respectively. On the same day, D 569 square meters was converted into a water supply site.

The sum of land after each of the above sub-divisions is "the land of this case", and where each of the above land is specified, "the land of this case" is "the land of this case" in order C, D, and E, the above lot number.

E. On November 16, 2002, the Plaintiff, the president of the Republic of Korea, on November 16, 2002, completed the registration of transfer of ownership on the ground of a gift made on October 28, 2002, with respect to each of the co-owned shares B, 1065/1940 of the instant land.

F. Meanwhile, B married with F and placed 2 South and North Korea women including Plaintiff, etc., but F was dead on January 15, 2004, and B on January 20, 2007 and died on January 20, 2007, respectively, the Plaintiff, G, H, and I as their children.
