A defendant shall be punished by imprisonment for not more than ten months.

Punishment of the crime

On November 21, 2006, the Defendant received a summary order of 2 million won or more due to a violation of the Road Traffic Act (driving without a license), etc. on July 25, 2007, a summary order of 2 million won or more due to a violation of the Road Traffic Act (driving without a license), and on October 5, 2007, a summary order of 4 million won or more due to a violation of the Road Traffic Act (driving without a license), respectively, at the Sungwon District Court's Sungnam branch on September 20, 201, from the Suwon District Court's branch on September 20, 201, the Defendant was sentenced to imprisonment for one year with prison labor for a violation of the Road Traffic Act (driving without a license) and on November 15, 2012, the execution of the said sentence terminated on July 3, 2013.

On August 25, 2013, the Defendant was driving without obtaining a driver’s license under the influence of alcohol with a blood alcohol concentration of 0.160% at around 23:20 on August 25, 2013, and from the end of the 48-3rd road in the small and medium west-gun of Gyeonggi-do to the road located at a point of 400m in the two parallel direction of the small and medium west-ri, the 9km area of approximately 9km to the 800 m of the YY.

Therefore, even though the defendant violated Article 44 (1) of the Road Traffic Act more than twice, he again driven a motor vehicle under the influence of alcohol in violation of Article 44 (1) of the Road Traffic Act.

2. The Defendant violated the Guarantee of Automobile Accident Compensation Act did not subscribe to mandatory insurance at the time and place specified in paragraph (1), and operated a non-registered 800CC Rool sportsman as above.
