A defendant shall be punished by imprisonment for not less than two years and six months.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

Punishment of the crime

On December 6, 2013, the Defendant first came to know in the course of hosting with the victim E (10 years of age) through smartphone-making display in the D Reading Office located in Busan-si, Busan-si.

1. On December 7, 2013, the Defendant received transmission of a photographic file exposed to chest from the victim, leading to the front trial, by holding the Defendant, using smartphones at the said D Reading Room, around December 16, 2013, at around December 7, 2013.

After that, the Defendant, at around 21:26 on the same day, received a transmission of the victim’s personal body photograph by threateninging the victim to and reconvening the victim with the message, such as “Isle”, “Is whether I would have been subject to punishment if Isponed or falsified,” “Is if you have not sent 10 papers, and if you seem to have a certain day on the Twitday, Ispon’s personal body photograph,” and “Ispon with the knowledge that I would have known that Isponed, Ispon?”

As such, the Defendant produced child or juvenile pornography, which caused a sense of sexual shame of ordinary people, which was taken by exposing part of the body of the victim, and caused the victim to perform an act of intimidation without any obligation.

2. On December 8, 2013, the Defendant received a transmission of the victim’s personal body pictures by threatening the victim to a message, such as “I am unable to have a mental disorder,” “I am more sending photographs,” and “I am in school, I am unable to bring the victim’s body pictures,” on December 8, 2013.

As such, the Defendant produced child or juvenile pornography, which caused a sense of sexual shame of ordinary people, which was taken by exposing part of the body of the victim, and caused the victim to perform an act of intimidation without any obligation.
