A defendant shall be punished by imprisonment for not less than two years and six months.
The defendant shall complete the sexual assault treatment program for 80 hours.
Reasons
Punishment of the crime
1. Around January 9, 2019, the Defendant sent the victim’s face to Defendant’s cell phone by using the victim F (n.e., the 13 years old)’s photograph from the subway station service room located in Seodaemun-gu Seoul, Seoul, at around 02:30 on the violation of the Act on the Protection of Children and Juveniles against Sexual Abuse (production, distribution, etc. of obscene materials), and the Child Welfare Act (in the case of a child), and the forced Defendant received a transmission of the victim’s face from the Defendant’s victim F (n.e., the 13 years old) who was aware of the victim’s face through E to use the Defendant’s cell phone. The Defendant sent the victim’s photograph as if he/she spreads the victim’s image on the Internet, and received a transmission of the victim’s chest exposed image.
Then, at around 09:30 on the same day, the Defendant sent to the victim a message, “as soon as possible after affixing a photo on his/her face and chest, and then sending a photograph and a screen image,” at the Defendant’s residence in Seongbuk-gu Seoul, Seongbuk-gu, Seoul, the Defendant was sent from the victim a photograph, and received from the victim a photograph and a screen image that was promptly collected on his/her face, chest, and chest.
At around 13:20 on the same day, the Defendant continuously sent to the victim a message, “I am off clothes, bridges a bridge, and affix a photo with a sound book affixed. I am sent to the sound book a photograph and screen image with an object affixed. I am sent from the victim a photograph and screen image.”
Accordingly, the defendant threatened the victim to commit an unobligatory act, produced obscene materials for the use of the juvenile appearing by the victim, and committed sexual abuse such as sexual harassment that makes the victim feel sexual humiliation.
2. The Defendant who attempted coercion is at the residence of the Defendant as described in paragraph (1), around January 21, 201, at around 21:00.
