1. 유사강간 피고인은 2015. 1. 17. 12:00경 포천시 영북면 산정리에 있는 인적이 드문 도로변에 피고인 소유인 D 포터 화물차를 주차한 후, 피해자 E(여, 64세)에게 “한 번 하자”고 하였으나 피해자가 거절하자, 피해자에게 “어떤 놈은 씹을 하고 싶다고 얘기하고 하냐”라고 말하며 피해자의 왼손을 피해자의 등 뒤로 넣어 등으로 눌러 움직이지 못하게 하고 오른손으로는 피해자의 오른손을 잡고 배 위에 올려놓는 등 피해자의 반항을 억압한 후, 몸을 틀어 왼손으로 피해자의 바지와 팬티 안으로 손을 넣어 음부를 만지고 손가락을 피해자의 음부 내에 집어넣고 바지와 팬티를 내린 후 입으로 피해자의 음부를 핥고 상의를 올려 가슴을 애무하였다.
