1. The judgment of the court of first instance is modified as follows.
Defendant Or Blue Refriger Co., Ltd. shall be the Plaintiff, 107,275.
Reasons
1. Basic facts
A. The status of the party is one of the owners and lessors of fishery products processing business, wholesale and retail business, and warehouse business, and 325-1 ground buildings (hereinafter “instant building”). The Plaintiff is a corporation engaged in the processing, manufacturing, and export of fishery products, such as cream, and the Plaintiff leased and used 355 square meters (hereinafter “part 1”) and 45 square meters from the first floor of the instant building from Defendant Orbru on February 16, 2010, among the first floor of the instant building, from around 206, 250 square meters (hereinafter “section 2”) among the first floor of the instant building and the first floor of the instant building (hereinafter “instant building”) around 206.
The fire in this case has been used until the occurrence date of the fire in this case, and the specific possession status at the time of the fire in this case is as shown in the attached Form.
B. On January 31, 201, around 19:50, a fire occurred in the ceiling of the corridor of the first floor underground of the instant building (hereinafter “instant fire”) and the Plaintiff’s damage was inflicted on KRW 107,275,695 due to the fire of the instant building and the machinery, office fixtures, etc. owned by the Plaintiff, as indicated in the separate sheet, and the detailed details thereof were as indicated in the separate sheet.
C. 1) The investigation report (Evidence No. 26) by the Busan District Police Station and the fire appraisal report (Evidence No. 27) prepared by C, a specialist in the investigation of the fire headquarters of the Busan District Fire Agency, stated that “one of the electric wires distributed to the cable tracks installed in the corridor gate located on the underground floor, appears to have been caused by the sprinke of the Sprink at the same time as the wire was destroyed due to a sudden defect.” 2) The fire site investigation report (Evidence No. 28) at the Busan District Fire Station (Evidence No. 28) on the fire site investigation report at the Busan District Fire Station, and the fire appraisal report prepared by C, a specialist in the investigation of the fire headquarters of the Busan District Fire Agency (Evidence No. 27) are the same as to the causes of the fire in this case.
