A defendant shall be punished by imprisonment for not more than ten months.
Reasons
Punishment of the crime
The defendant, who married with B and resided in Indonesia, was invested in the development costs of the state mine from the Victim C Co., Ltd. and developed the state mine in Indonesia Island.
1. Embezzlement;
A. On September 23, 201, the Defendant entered into a contract for the development of the fourth mine area of the Indonesia Island with the victim company and the defendant as the guarantor at a hotel in Indonesia as well as B on September 23, 201, and entered into a contract for development of the fourth mine of the Indonesia with the defendant as the guarantor, and then, on October 6, 201, the victim company entered into the account in the name of B established in Indonesia as a corporation in the Republic of Indonesia of Hana Bank with the amount of USD 37 million (Korean US$36 million, KRW 36 billion, KRW 300,000), and around November 11, 2011, deposited the amount of USD 11,163 (Korean US$ 12 million, KRW 12 million, KRW 100,0000, KRW 2400,000,000).
B. On August 10, 2012, the Defendant: (a) completed the development of the Jeju Mining Area No. 3 with the representative of the victim company D prior to the clerical error in the Islamic Republic of Korea; (b) sent the amount of KRW 10 million as development costs; and (c) deposited USD 90 million in the name of the Plaintiff’s Indonesia Corporation established in the Indonesia Corporation on August 10, 2012; and (d) embezzled the amount of KRW 7 million by arbitrarily consuming the amount of KRW 10 million in the name of the Plaintiff’s company established in the Indonesia Corporation; and (e) embezzled the amount of KRW 10 million in the name of the Plaintiff’s Indonesia Corporation.
2. On June 2012, the Defendant: “Around the end of Indonesia Island, the Defendant: (a) caused an accident in which the panel of the mine was buried in the main mine in the Jeju Indonesia No. 4 mining area; (b) died; and (c) caused the death of one side of the mine; and (d) was the victim of the mining accident and his/her bereaved family members.
