1. Defendant E Co., Ltd.: (a) from September 10, 2015 to September 10, 2015, 59,937,412 won and its amount.
Reasons
1. Determination on the part of the claim against Defendant B and D Co., Ltd
A. The gist of the claim by Plaintiff B and D Co., Ltd. is to seek payment from Defendant E for each of the following goods:
1) From June 27, 2013 to July 22, 2014, Plaintiff B provided the Defendant E with a gold form necessary for the production of tap water produced and sold by Defendant E. The product price reaches KRW 26,840,000 in total. 2) Plaintiff D Co., Ltd. (hereinafter “L”)’s claim portion of Plaintiff D Co., Ltd. (hereinafter “L”) supplied Defendant E with raw materials of tap water (for example, stom), the Plaintiff C Co., Ltd. supplied Defendant E with the remainder of the product price that was not received from Defendant E is KRW 59,937,412.
B. In this case, Defendant E did not reply to the above part of the plaintiffs’ claim. However, during the proceeding of the lawsuit in this case, Defendant D participated in the lawsuit in favor of Defendant E, and Defendant Wurter asserted to the effect that the above plaintiffs denied the existence of each claim against Defendant E.
1) The reasoning of the judgment on the claim portion of Plaintiff B is insufficient to deem that Plaintiff B’s claim for the payment of goods against Defendant B was proven, and there is no other evidence to prove that there was a claim for the payment of goods against Defendant B (not only is the signature indicated in the evidence No. 2, but also there is no other objective evidence to verify the content of the supply of goods as indicated therein, and Plaintiff B did not submit any additional proof despite the request for the proof of this Court.
Therefore, the part of the above claim against the defendant Eul is rejected. 2) In full view of the reasoning of the judgment as to the plaintiff Eul's claim and the whole purport of the argument as to the plaintiff Eul's claim No. 5 (a written confirmation) and the whole purport of the argument, the plaintiff Eul evidence No. 5 is the "debtor" column.
