A defendant shall be punished by imprisonment for one year.
Reasons
Punishment of the crime
[Criminal Power] On April 25, 2012, the Defendant was sentenced to imprisonment with prison labor for a violation of the Punishment of Violences, etc. Act (joint injury) at the Seoul Western District Court on April 25, 2012, and the sentence was finalized on June 30, 2012 and is currently in the grace period.
【Criminal Facts】
Defendant and E (in the course of life transfer) knew that G (i.e., a year of imprisonment with labor on August 25, 2012) who operated F, had difficulty in funding, and (ii) although G was well aware of the fact that it had no intent or ability to pay the installment cost or the lease fee even if it purchased a vehicle by installment or leased the facility, G was well aware of the fact that it had no intent or ability to pay the installment cost or the lease fee, the Defendant and E (in the course of life transfer) proposed to the effect that “Korea is operating Hrenk, and in the name of F Co., Ltd., 50 million won, if it is transferred by purchasing or leasing a high-class external class two units in the form of high-class external class or lease.” G consented thereto

On August 31, 201, the victim Aju Capital Co., Ltd. fraud G refers to a false statement to the effect that “The defendant would pay 2,395,810 won each month for every 36 months from September 20, 201 to September 20, 201,” and that the defendant did not have the victim and Jenz E350 won to pay 69,920,000 won to the defendant for installment financing, and the defendant did not enter into a contract with the victim to purchase the above 90,60,000 won to purchase the above 36 months of installment financing.” The defendant did not pay 2,395,810 won each month for each 36 months from Sep. 20, 2011 to Sept. 20, 2014 to the effect that the defendant and Jenz E350 won for one vehicle.
Accordingly, the Defendant, in collusion with E and G, inducedd the victim and acquired pecuniary benefits equivalent to KRW 69,920,000.
2. All the provisions of the preceding paragraph and all the relevant fraud G related to Korea Co., Ltd., Ltd., which has held the victim Mesium events.
