A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

On June 24, 2018, around 13:25, the Defendant assaulted the victim C (60 years of age) who is a member of the early axis-gu, Seoul Metropolitan Government Nowon-gu, with the head of the Defendant at one time, and the victim C (60 years of age) as the head of the early axis-gu, with the victim’s head at one time, and with the victim’s head at the Defendant’s left hand, as the Defendant was expelled from other people, by using the victim’s head.

In light of the risk of the instant crime committed by assault, including excessive possession of objects dangerous to sentencing under Article 48(1)1 of the Criminal Act, and the occurrence of the victim’s head, etc., the crime is not good, and the Defendant has been punished several times for the same kind of violent crimes.

However, considering the fact that the defendant shows the attitude of recognizing and opposing the defendant's mistake, the defendant's age, sexual conduct, environment, motive and background of the crime, relationship between the defendant and the victim, and circumstances after the crime, the punishment as ordered shall be determined.
