Punishment of the crime

On May 6, 2008, a civil society organization with 1,500 U.S. beef co-operation, etc. (hereinafter referred to as the "Countermeasures") organized a "National Countermeasure Committee against the full import of U.S. beef risks" (hereinafter referred to as the "Countermeasures Committee") for the purpose of organizing a strike against the import of U.S. beef, asserting that "the phased import expansion agreement of U.S. beef entered into with the Government of the Republic of Korea on April 18, 2008 is a duplicative negotiation, as well as a result of undermining the citizens' health rights."

Since May 2, 2008, the countermeasures conference led to the ‘Madlelightlight assembly' held in Seoul Cheongyang, etc. from May 6, 2008, which was held by the Seoul Cheongyang, etc., and tried to enter into the Cheongdae River as a night outdoor assembly from May 6, 2008. Since May 24, 2008, the candlelight assembly, which was a night outdoor assembly, was held in the Cheong River square. From May 24, 2008, the countermeasures conference tried to stop the road-based demonstration, such as the three-way candlelight, from May 24, 2008 to the following day.

On the other hand, the government announced the results of additional negotiations on the expansion of import of U.S. beef on June 21, 2008, but the countermeasures meeting continued to hold a candlelight assembly by asserting the complete renegotiation rather than the additional negotiations.

On August 5, 2008, the countermeasures conference held a candlelight assembly from around 19:20 to 19:50 of the day when 2,700 members of the countermeasures conference were present.

On August 5, 2008, from around 19:36 to 20:35, the Defendant participated in the foregoing candlelight assembly with the flagpole, which is stipulated as the "Korea-U.S. Free Trade Agreement Doctrine Committee" in the Seoul Jongno-gu Cheong River square and the Northwest-dong Doctrine Road, etc., and occupied the above candlelight Doctrilelight assembly with the above candlelight assembly, making it impossible for the Defendant to pass the vehicle.

As a result, the Defendant conspired with the military participating in the above candlelight assembly and interfered with the traffic on the land.
