The defendant shall be innocent.
Reasons
1. The Defendant is the head of the “D church” in Geumcheon-gu Seoul Metropolitan Government, and there is a continuous dispute with E, a pastor of the above church.
On February 28, 2015, the Defendant suspended the operation of three CCTVs by opening three a course from among the eight CCTVs installed by the victim E and cutting off the electric wires installed inside, on the ground that he/she monitoring the towing of the emergency countermeasure committee that he/she led on the second floor of the above church around 13:30 on February 28, 2015.
2. Determination
A. The following facts are acknowledged according to the Defendant’s legal statement, E’s legal statement, and evidence Nos. 1 through 6 (including each number) submitted by the Defendant.
1) From June 2014, there was a conflict between about 25 believers and about 20 believers who support E, who are the pastors of the D church, and around 20 believers who oppose E, from around June 2014, there was an emergency countermeasure committee.
2) E installed 8 CCTV at a church around November 2014 in order to secure evidentiary materials about the dispute situation, upon the occurrence of the dispute inside the church, and the emergency countermeasures committee, including the Defendant, demanded the removal of CCTV while setting up CCTV, but E did not accept it.
3) New Dos and emergency response committees supported E agree to see each way separately, and on Sundays A.M., on Sundays A.M., on Sundays A.M., the first instance of the emergency response committee, and on Sundays A.M., the third instance of CCTV to see the inside of the towing distribution was taken by the first instance of the emergency response committee, and E submitted photographs to the case of preliminary injunction by cutting down CCTV images.
4) On December 2, 2014, the Defendant reported that CCTV installed in the Korea Internet Agency for Reporting Personal Information Infringement Center was doubtful to be used differently from the installation purpose. The Korea Internet Agency visited D church and investigated the installation status of CCTV.
