The defendant is not guilty. The summary of the judgment against the defendant shall be published.

1. The Defendant is a representative director of F, a corporation with the objective of real estate development business, etc. in Yangcheon-gu Seoul Metropolitan Government E-building 401.

Around August 10, 2012, the Defendant: (a) concluded an internal interior interior interior interior interior interior interior interior interior construction contract for the fourth floor of the Yangcheon-gu Seoul building E in the name of the KHAF in the name of the KAF in G; and (b) concluded a contract for the construction project amount of KRW 2.42 billion with the LAF in the name of the KAF in the name of the HAF; and (c) concluded a contract for the construction project with the KAF in the name of the KAF in the name of the KAF in the name of the KAF; (d) concluded a new contract for the construction project with the representative director of the KAF in the form of “1.5 million won with the first progress payment; (e) KRW 15 million with the second progress payment; (e) KRW 75 million with the third progress payment; and (e) KRW 34.7 billion with the fourth progress payment; and (e) concluded a new contract for the construction project with the victim up to KRW 3.3013 billion.21.27.21.21.

However, in fact, the LAF at the time, including the trust debt of a financial institution in the amount of 6.4 billion won and the loan debt of a financial institution in the amount of 2.5 billion won, did not engage in any other profit-making business that is basically able to prepare funds necessary for the operation of the company, including interest on the above debt, and as such, it did not have any intent or ability to pay the construction price in accordance with the above contract even if the victim is responsible for the management of the company.

Ultimately, the Defendant, as above, had the victim deceptiond and completed the said interior work, paid only KRW 276,787,875 of the total construction cost which was finally settled with the victim, and did not pay the remainder of KRW 1,90,812,125 of the total construction cost.
