1. Part of the judgment of the first instance, excluding the part concerning E and the part concerning the confirmation request among the application for intervention by an independent party intervenor.
Reasons
1. The first instance court dismissed the part of the Intervenor’s request for intervention as an independent party to the trial on the ground that there was no interest in confirming the Plaintiff’s claim for confirmation, and this part is excluded from the scope of the party’s trial, since the Intervenor did not appeal.
2. Basic facts
A. 1) Labor relations with P Co., Ltd. P Co., Ltd. (hereinafter “foreign company”).
(2) In order to carry out the said construction, the Information and Communications Technology Co., Ltd. subcontracted the construction of telecommunications base facilities to the Korea Radio Base Co., Ltd. (hereinafter “Telecommunications Co., Ltd.) on December 6, 201, the non-party company entered into a labor contract with K, which is an electrical power exhauster, from December 6, 2011 to December 30, 201, with the daily wage of KRW 250,000,00. The contract was concluded between NN and the owner of the vehicle O4.5 tons truck (hereinafter “instant vehicle”) of the same day, which is the owner of the instant vehicle (hereinafter “instant vehicle”) from December 6, 2011 to December 30, 2011.
B. At around 08:30 on December 29, 201, N was instructed by the non-party company to transport electric lines to a work site, and around 08:30 on December 29, 201, the N had the non-party company carry one electric drum in loading the instant vehicle and let the non-party company run the instant vehicle at the entrance of the Gyeongjin-gun TWing Forest Forest, the work site. 2) The non-party company stopped the other workers of the non-party company at the instant vehicle and parked in the direction to prevent the front portion of the instant vehicle from getting off.
