1. The Defendant’s KRW 21,267,464 as well as 5% per annum from March 11, 2016 to December 13, 2016 to the Plaintiff.
Reasons
1. Facts of recognition;
A. (1) The Plaintiff is a company that newly constructs and sells a 2nd underground and 15th floor Ctel building (hereinafter “instant building”) on the ground of 27,612m3m2 in Yeongdeungpo-gu Seoul Metropolitan Government, Yeongdeungpo-gu (hereinafter “S&D”), and the Korea Urban Development Co., Ltd. (hereinafter “Korea Urban Development Co., Ltd.”) is a contractor who has been awarded a contract for construction of the instant building (hereinafter “instant construction”) from J&D, and the Korea Asset Trust Co., Ltd. (hereinafter “Korea Asset Trust Co., Ltd”) is a trustee who received real estate trust (hereinafter “instant trust”) from U&SD in relation to the instant sales business, and the Promotion Savings Bank, Korea Savings Bank, Korea Savings Bank, Korea Savings Bank, and Gyeonggi Savings Bank Co., Ltd. (hereinafter “Promotion Bank, etc.”) is a first beneficiary of the instant trust.
Shex Abndi reported the commencement of the instant construction work on July 26, 2004, and the Korea Urban Development commenced the instant construction work from around that time.
Article 22(1) of the Act on the Protection of Maritime Affairs and Fisheries Enterprises (hereinafter referred to as the “Act on the Protection of Civil and Fisheries Enterprises”) of the Act on the Protection of Civil and Fisheries Enterprises (hereinafter referred to as the “Act on the Protection of Civil and Fisheries Enterprises”) of the Act on the Protection of Civil and Fisheries Enterprises.
B. (i) On July 31, 2004, the Plaintiff entered into a contract under which the 12th floor of the instant building was sold at KRW 310,909,000 (hereinafter referred to as the “instant sales contract”) among the instant buildings by setting the sales price of KRW 310,90,00. The instant sales contract includes the following contents.
The scheduled date of occupancy: Article 2 of the 23-month after the commencement (the scheduled date of occupancy may be somewhat changed according to the process, and the accurate date shall later be the individual notice key).
