1. The Defendant’s KRW 65,567,542 as well as its annual 6% from September 14, 2012 to June 5, 2015 to the Plaintiff.
Reasons
1. Facts of recognition;
A. Status 1) The Plaintiff is attending C University and D (hereinafter “instant building”)
(2) On June 25, 2012, the Defendant is an insurer that entered into an insurance contract (hereinafter “instant insurance contract”) with C University with the following content.
【Insurance Policy (Insurance Policy) Insurance Types: Insured contractor and insured: The insurance period from June 26, 2012 to June 16, 2013: 200,000 to June 26, 2013: Insurance per capita for school facilities compensation of KRW 200,000,000,000 for internal treatment expenses (Ⅱ) and insurance conditions: E insurance policy, special clause for internal treatment expenses (Ⅱ), special clause for new and additional clauses, etc.
B. The Plaintiff, on September 13, 2012, went to the instant building on or around 2:00, on the following day: (a) however, the first floor door was locked with the studs, and the security guards did not appear to have the first floor door; (b) through emergency stairs, the Plaintiff fell down on the rooftop and fell off trees going to the rooftop; and (c) the Plaintiff suffered injuries, such as lower half half-yearly rain, damage to the horse gun, and exhaustr down No. 4 of the year 8.
(hereinafter referred to as “instant accident”). C.
1) At the time of the instant building, there was no separate entrance other than the 1st floor entrance, and the 1st floor steel door was always set up below the emergency stairs connecting the instant building and the water tank building. Therefore, in order to move from the instant building, it was inevitable to pass through the 1st floor entrance or to select the method of getting out from the rooftop of the water tank building connected with emergency stairs, and there was no other alternative. 2) The time of closure of the instant building from the 12:00 to the 05:00 of the new wall at the night, and even during the closure time, the 1st floor entrance was opened at the time of the instant building without the aid of the security guards.
