All appeals by the defendant and prosecutor are dismissed.

1. Summary of grounds for appeal;

A. In light of the fact that the victim Z brought the used vehicle owned by the defendant to the repayment of property, received dividends in the auction procedure for the land owned by the defendant, and most of the funds received from the victims were used as the expense of a private teaching institute, and there was no actual benefit, the sentence of the court below that sentenced one and a half years of imprisonment is too unreasonable.

In light of the fact that the crime of this case committed by the public prosecutor was committed by the Defendant, who operated a private teaching institute, by deceiving the victims with money in the name of transfer of the foreign teaching institute or related expenses, and did not operate a private teaching institute for a long time after receiving a long-term advance payment from his parents, and the period of the crime is more than one year, and the majority of the victims are more than 300,000,000 won, and the amount of the damage is relatively large, the crime is not good, and the Defendant is more serious to the victims even while being tried.
