A defendant shall be punished by imprisonment for two years.

1. Fraud;
A. The Defendant: (a) was a person who worked for approximately two years as an employee in the Pak-gu, Busan; and (b) was willing to acquire a mobile phone device by deceiving the latest smartphone that the value of the mobile phone device was not paid along with the mobile phone charges and using it via the mobile phone himself/herself; and (c) making a false statement that the mobile phone value and the mobile phone fee are paid normally.
On the end of May, 2013, the Defendant concluded that “two mobilephone devices are needed. If the Defendant transferred two mobile phones which are not opened, the Defendant would open without a mold and pay the agreed value of the device and the fee for the use of the mobile phone.”
However, the fact, however, only attempted to sell a mobile phone that is not opened to a mobile phone operator, and there was no intention to open the mobile phone in the name of the defendant.
Nevertheless, the Defendant, as such, obtained the two smartphones from the victim, namely, Samsung Galthal ju, which is equivalent to the market value of 1.8 million won at the seat, and acquired them by the victim.
B. On June 13, 2013, the Defendant made a false statement to the Busan High Police Station criminal department located in Busan High Police Station located in Busan High-dong 408-4, Busan High-dong, Busan High-dong, stating that “A victim E was subject to a final judgment of a fine of KRW 600,000,000 as a crime of fraud from the Changwon Prosecutors' Office, and was arrested. Nevertheless, the defendant made such a false statement and caused the victim to transfer the Fudio 603, 600,000 won to the Busan District Prosecutors' Office, thereby acquiring property profits equivalent to the same amount.
