A은 2014. 3. 1. 20:10경 인천 서구 D에 있는 E치킨 앞에서, 시비가 있다는 112신고를 받고 출동한 인천 서부경찰서 F지구대 소속 경찰관 G으로부터 귀가를 종용받자 갑자기 G에게 “씹새끼야 짭새 새끼야”라고 욕설을 하고 주먹을 쥐고 가운데 손가락으로 올려(일명 ‘fuck you') G을 능멸하여 G으로부터 제지를 당하자, 머리로 위 G의 왼쪽 뺨 부위를 들이 받고, 발로 G의 가슴 부위를 수회 걷어 차고, 위 G의 바지를 잡아 찢는 등 폭행하고, 그곳에 있던 피고인 A의 모 피고인 B도 이에 가세하여 “야이 새끼들 다 죽어라”라고 욕설을 하고 위 경찰관 G과 함께 출동한 경찰관 H의 머리카락을 잡아 흔들고 발로 H의 정강이 부위를 수회 걷어찼다.
