Based on the reasons indicated in its reasoning, the lower court maintained the first instance court that acquitted the Defendant on the charge of violating the Act on the Aggravated Punishment, etc. of Specific Economic Crimes (Fraud) due to fraudulentation of investment funds related to Chinese Internet business among the facts charged in the instant case.

Examining the reasoning in light of the record, the lower court did not err in its judgment by violating logical and empirical rules and by exceeding the bounds of the principle of free evaluation of evidence, or by misapprehending the legal doctrine on fraud.

Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
