Punishment of the crime

[Criminal Power] Defendant C was sentenced to a fine of KRW 7 million for a crime of gambling opening in the Daegu District Court Kimcheon on March 27, 2013, and Defendant D was punished twice due to gambling.

【Criminal Facts】

1. 피고인 B 피고인은 별지 범죄일람표(2), (3) 기재와 같은 일시, 장소에서 땅바닥에 당구천(길이 약 50m)을 깔고 그 당구천 위에 세로로 흰색 테이프를 붙여 경계를 나눈 후 양쪽을 Ｏ,Ｘ로 표시하여 팀을 나눈 다음 화투를 Ｏ,Ｘ 팀에 각 3장씩 보이지 않게 덮어 놓고 도박자들로 하여금 최저 5만원에서 최고 수백만원의 판돈을 걸게 한 후 3장의 화투를 뒤집어 같은 패 3장이 나오면 1등, 그 다음은 3장의 화투 숫자를 합한 끝 숫자가 9에 가까운 쪽이 이기게 되는 방법으로 이긴 팀에서 진 팀의 판돈을 모두 가져가는 방식으로 이루어지는 I(2013. 3. 28. 구속기소) 등이 개장한 속칭 ‘아도사끼’ 도박판에 도박자로 참가하여 하루 평균 판돈 1억 원 상당의 규모로 약 100회에 걸쳐 위와 같은 방식으로 ‘아도사끼’ 도박을 하였다.

2. Defendant C participated in the gambling box “Adogdog” box opened by J, etc. at the same time and place as the date and time set forth in the attached Table Nos. 8 through 12, such as the date and place set forth in paragraph 1, and carried out gambling at approximately KRW 100 million per day on an average of the total amount of KRW 100 million per day in the same manner as described in paragraph 1.

In this respect, the Defendant habitually stuffed five times.

3. The Defendant D, as indicated in the annexed list of crimes (1), Nos. 1, 4, and 7, and at the same time, as indicated in paragraph 1 at a place, participated in the gambling “Adogin” bulletin opened by J, etc., as gambling, and extended over approximately KRW 100,000 per day on an average of KRW 100,000 per day.
