이에 피고인은 위 C 등과 각자의 맡은 역할을 실행하여, 2012. 2. 21. 23:00경부터 다음날 05:00경까지 상주시 E에 있는 F팬션에서, 땅바닥에 당구천(길이 약 50m)을 깔고 그 당구천 위에 세로로 흰색 테이프를 붙여 경계를 나눈 후 양쪽을 Ｏ,Ｘ로 표시하여 팀을 나눈 다음 화투를 Ｏ,Ｘ 팀에 각 3장씩 보이지 않게 덮어 놓고 도박자들로 하여금 최저 5만 원에서 최고 수백만 원의 판돈을 걸게 한 후 3장의 화투를 뒤집어 같은 패 3장이 나오면 1등, 그 다음은 3장의 화투 숫자를 합한 끝 숫자가 9에 가까운 쪽이 이기게 되는 방법으로 이긴 팀에서 진 팀의 판돈을 모두 가져가는 방식인 속칭 ‘아도사끼’라는 도박판을 개설하고, 약 30명 상당의 도박자들을 모집하여 이들로 하여금 약 100회에 걸쳐 전체 판돈 약 1억 원 상당의 규모로 ’아도사끼‘ 도박을 하게 하여 도박개장비(속칭 ’데라‘) 명목으로 판돈의 10%를 도박자들로부터 받아 약 700만 원 상당의 수익을 올렸다.
