그럼에도 피고인들은 2011. 10. 6.경부터 같은 달 12.경까지 군포시 H, 4층에 있는 ‘I게임장’에서, 피고인 A는 위 게임장 운영 전반을 관리하고, 피고인 B은 위 게임장의 명의자로서, 위 게임장에 전체이용가 등급분률르 받은 비경품 게임기인 ‘점프몬 게임기’ 40대를 설치하고, 그 곳을 찾아온 불특정 다수의 손님들로 하여금 위 점프몬 게임기를 이용하게 하되, 자동진행장치인 속칭 ‘똑딱이’를 사용하게 하고, 현금 10,000원에 상응하는 빨간색의 점프몬 서비스 이용권 쿠폰을 발행해 주고, 게임기 연출에 따른 화면배경에 ‘늑대울음 효과음, 고래소리 효과음, 번개가 치고 UFO 등장시 나타나는 효과음’ 등에 대응하여 1단계 20,000점 내지 50,000점, 2단계 20,000점 내지 50,000점, 3단계 100,000점부터 300,000점까지 점수를 부여하는 등 쿠폰 점수에 상당하도록 게임기에 게임머니를 충전해 주고, 손님들이 획득한 점수에 상응하는 게임머니를 충전해 주거나 손님들에게 남은 점수에 상응하는 보관증(서비스 이용권)을 교부하였다.
