1. 피고인 A, 피고인 B의 공동범행 피고인들은 2019. 7. 6. 18:20경 태백시 D 앞 노상에서 피해자 C(60세)과 텃밭 경작문제로 시비가 되어, 피고인 B는 손으로 피해자를 밀치고 소지하고 있던 위험한 물건인 호미로 피해자의 온몸을 수회 내리치고 발로 수회 걷어찼으며, 피고인 A는 주먹으로 피해자의 얼굴을 수회 때리고 피해자의 몸을 붙잡아 바닥에 넘어뜨린 다음 주먹으로 피해자의 어깨를 수회 때렸다.
