Punishment of the crime

[Criminal Power] On February 12, 2019, the Defendant was sentenced to two years of imprisonment with prison labor for the preparation of qualification documents at the Daejeon District Court on February 12, 2019, and the judgment was finalized on November 28, 2019.

【Criminal Facts】

Around November 29, 2017, the Defendant concluded an agreement with the representative director of the committee for promotion of a regional housing association of the district DD zone, which is a housing construction consulting company, to support partnership affairs (agency) with regard to the "Gimpo City D (G30,00, G300, hereinafter referred to as "Ginpo City) apartment association construction project" with F, which is the victim's representative director of the committee for promotion of a regional housing association of the district DD zone, and concluded a false agreement with the victim, stating that "the victim will receive at least 80% consent of the land owners sufficient for the establishment of the association within three months if he/she supports business promotion expenses."

However, since the committee for promotion of the regional housing association of the D District did not have been established at the time and did not have been established thereafter, the defendant was not the chairperson of the committee for promotion of the D District District Housing Association, and even if the victim received business promotion expenses from the victim, there was no intention or ability to receive a written consent to land use of at least 80% of landowners sufficient for establishing the association within three months.

Around November 29, 2017, the Defendant, by deceiving the victim, received KRW 30 million from the victim to the Agricultural Cooperative account (Serial number: H) in the name of the C Educational Association; KRW 5 million from the same account around December 17, 2017; KRW 7 million from the Agricultural Cooperative (Serial number: I); and KRW 30 million from the Agricultural Cooperative account in the name of D District Urban Development around January 15, 2018, respectively.

Accordingly, the defendant was given a total of KRW 72 million by deceiving the victim.
