1. The instant lawsuit shall be dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Basic facts
A. On March 1, 2011, the Plaintiff was elected as the representative of the said apartment on March 1, 201 and the president of the Defendant, as the occupant of the B apartment in Seoul Special Metropolitan City, Nowon-gu (hereinafter “instant apartment”). On February 28, 2013, the Plaintiff was again elected as the representative of the said apartment on February 14, 201 and the president of the Defendant.
B. However, on August 19, 2014, the election commission affiliated with the Defendant (hereinafter “election commission”) issued a vote of dismissal for three representatives, such as the 14th, 103 representative D, 105 representative E, etc. of the instant apartment, including the Plaintiff, on the ground of the Plaintiff’s misconduct, and 172 households among the 202 occupants of the said apartment complex participated in the voting and 161 households, 4 households opposing the dismissal, and 7 households null and void, and the election commission announced that “three persons, including the Plaintiff, were dismissed from the representative of each Dong.”
C. The election commission, which occurred on October 7, 2014, held two representatives of 14th, 104, 104, 105, and 105, of the instant apartment units (the term of office until February 28, 2015). The 161 households, among the 226 households, participated in voting and elected C as 103 representatives, were elected as new chairpersons during the remaining term of office of the defendant.

(d) On January 27, 2015, the election commission shall conduct an election of the representative for each Dong at the 15th period of apartment buildings in this case.
