A defendant shall be punished by imprisonment with prison labor for up to six months.

However, the execution of the above sentence shall be suspended for a period of two years from the date this judgment became final and conclusive.

Punishment of the crime

On February 20, 2018, the Defendant posted a false statement to the effect that “The Defendant would send money to the victim D who reported and contacted this writing to the effect that “the Defendant will send money if you transfer money.” In fact, the Defendant did not have any intention or ability to send the goods even upon receiving the money from the Defendant’s office located in the Dongjak-gu Seoul Metropolitan Government C building.” The Defendant sent a false statement to the effect that “the Defendant would send money to the Defendant if you transfer money to the Defendant.”

The Defendant received KRW 350,00,00 from the injured party for the same day as the price for the goods, and received KRW 7,577,00 in total from around that time to January 11, 2018 in the same manner as indicated in the list of crimes in attached Form 28 in the same manner.

Accordingly, the defendant was informed of the victims to receive property.

On May 21, 2018, the Defendant posted a false statement to the effect that “The Defendant would send a new letter upon the transfer of money to the victim F who visited the Defendant,” without any intention or ability to send the goods, even if he/she received the money from the Defendant,” and that “I will send a new letter upon the transfer of money to the Defendant.” The Defendant posted a false statement to the effect that “I will send a new letter upon the transfer of money to the Defendant F. who sent money.”

On May 21, 2018, the Defendant received 300,000 won from the damaged person as the price for goods from his/her own account under the name of the Defendant, and received 200,000 won from his/her own bank account under the same name as around 21:28 of the same day.

Accordingly, the defendant was given property by deceiving the victim.
