For the reasons indicated in its holding, the lower court reversed the first instance judgment that found the Defendant guilty on the ground that the instant public prosecution procedure constitutes a case where the indictment procedure violates the law and becomes null and void, and rendered a judgment dismissing the public prosecution.

In light of the relevant legal principles and records, the above determination by the court below is justifiable.
