Defendant shall be punished by a fine of KRW 700,000.

Where the defendant fails to pay the above fine, one hundred thousand won shall be one day.

Punishment of the crime

The Defendant was elected on June 13, 2018 at the 7th simultaneous local elections, following the election of a Gun Council member of Daegu Metropolitan City CGun Council member as a candidate for a constituency in Daegu Metropolitan City.

A candidate, his/her spouse, or his/her lineal ascendant or descendant, or sibling's birth place, status, occupation, career, etc., property, personality, act, organization to which he/she belongs, etc. shall not be published or published, or possessed for the purpose of distributing propaganda documents containing false facts, by means of a speech, broadcast, newspaper, communication, magazine, poster, propaganda document, propaganda document, or any other means in favor of the candidate (including a person who intends to become a candidate) by making a campaign speech or having another person elected or have another person be elected, and where he/she publishes an academic background, he/she shall not be published other than the regular academic background and the academic ability completed by a foreign country equivalent thereto.

Nevertheless, on April 27, 2018, the Defendant requested the business entity “F” located in Daegu-gu, Dong-gu to produce a preliminary candidate box for Defendant’s election campaign, and entered the irregular academic background in career column, “the completion of the G highest executive course,” and made 2,000 copies of the name box for election campaign in which the above irregular academic background is published (the vertical length) around that time, and produced 2,00 copies of the name box for election campaign (the horizontal type) for Defendant’s preliminary candidate box for Defendant’s election campaign at H located in Daegu-gu on April 27, 2018, upon requesting the business entity “I” located in H to produce the name box for Defendant’s preliminary candidate box for Defendant’s election campaign, stating the irregular academic background in the representative’s career column, “the completion of the G highest executive course,” and produced 2,00 copies of the name for election campaign (the street type) published in the said irregular academic background as above on April 28, 2018.

Since April 27, 2018 to May 14, 2018, the Defendant distributed approximately KRW 2,690 to the above 2,690 boxes for election campaign manufactured in one constituency, such as the Daegu JJ center for senior citizens, Daegu LAW center for senior citizens, etc.

As a result, the defendant distributed the name cards for election campaign in which the aforementioned non-regular academic background was stated for the purpose of winning the election, and announced false facts.
