Defendant shall be punished by a fine of KRW 700,000.

Where the defendant fails to pay the above fine, one hundred thousand won shall be one day.

Punishment of the crime

The Defendant was a candidate for the election of a member of the Gun Council in Daegu Metropolitan City, in the 7th simultaneous local elections on June 13, 2018, and went out to a candidate for the election district in Daegu Metropolitan City.

A candidate, his/her spouse, or his/her lineal ascendant or descendant, or sibling's birth place, status, occupation, career, etc., property, personality, act, organization to which he/she belongs, etc. shall not be published or published, or possessed for the purpose of distributing propaganda documents containing false facts, by means of a speech, broadcast, newspaper, communication, magazine, poster, propaganda document, propaganda document, or any other means in favor of the candidate (including a person who intends to become a candidate) by making a campaign speech or having another person elected or have another person be elected, and where he/she publishes an academic background, he/she shall not be published other than the regular academic background and the academic ability completed by a foreign country equivalent thereto.

Nevertheless, on April 27, 2018, the Defendant requested the business entity "E" located in Daegu-gu, Daegu-gu to produce a name tag for the defendant's election campaign, stating the non-regular academic background of "the completion of the highest course of business management at the graduate school of the graduate school of the Gyeong-gu Industrial University". Around that time, the Defendant produced 10,000 copies of the name tag for election campaign in which the above non-regular academic background is stated, and on May 3, 2018, requested the same business entity to produce a name tag for the preliminary candidate for the election campaign of the defendant, stating the above non-regular academic background, and around that time, produced 10,00 copies of the name tag for the election campaign for which the above non-regular academic background is stated.

From April 27, 2018 to May 7, 2018, the Defendant distributed approximately KRW 500 boxes for election campaign, such as G Centers in Daegu-gun F, the place of the single conference in Daegu-gun H, and the KGG in Daegu-gun J.

As a result, the defendant distributed the name cards for election campaign in which the aforementioned non-regular academic background was stated for the purpose of winning the election, and announced false facts.
